Annex Wealth Management has a Certified Divorce Financial Analyst® on our staff! Deanne Phillips, CFP®, CDFA®, ABFPsm, Director of Client Learning & Development, Deanne has over 26 years of financial services experience working directly with clients and 10 years prior in the education field.  

Deanne holds a bachelor’s degree from New York University and has been a practicing CFP® professional for over 20 years. She’s also a Certified Divorce Financial Analyst (CDFA®), and an Accredited Behavioral Financial Professional (ABFPsm), who assists our clients and prospective clients with financial transitions such as divorce. She’s been a guest speaker and lecturer at numerous local and national conferences and national banks and has published writings specific to Divorce specialty on thestreet.com. 

Through Annex Wealth Management, the role of our CDFA is twofold: education around the divorce process and analysis related to financial aspects of divorce including asset division projections per marital settlement agreements (MSAs) and qualified domestic relations orders (QDROs).

      For the 83% of you who take part in charitable giving the tax aspects of it can be complex, but using a few ground rules can help you navigate through it: 

      1. Always ask for a receipt if your donation is cash or exceeds $250 to one cause.  
      2. Get an independent appraisal in writing for gifts exceeding $5,000. 
      3. Subtract the value of any benefits to yourself before making the deduction (i.e. meals, entertainment, etc.).  
      4. Itemize your deductions if you suspect your total gifts may exceed the standard deduction. 
      5. Know the annual deduction limits for certain causes such as public charities and donor-advised funds. 

      The type of charitable gift you give can also impact the tax treatment of it and revolves around three key details:   

      1. Who you give the gift to

      2. How you organize the gift

      3. Typle of property you decide to give

        Discover What Probate Is & When It’s Needed.

        Probate may be one of the most misunderstood parts of the estate settlement process. Unfortunately, the term “probate” has garnered some negative connotations through headlines and heavily publicized cases having gone wrong and dragged on for years.  

        Probate is the court-supervised process to validate an individual’s Last Will & Testament and legally transfer ownership of property to the named beneficiaries, while protecting the rights of all heirs and creditors. That’s right, having a Will alone doesn’t avoid the probate process. So, if your estate plan relies on a Last Will, your loved ones may end up in Probate Court after your death! The probate process is also used if an individual dies without a Will. 

        Probate is necessary if you own assets in your sole name at death and there’re no joint owners, beneficiary designations, transfer on death, or payable on death instructions on the account. There’re certain types of assets and accounts that’ll typically avoid probate based on their ownership or beneficiary designations. These include:    

                • Jointly Owned Property – such as joint with right of survivorship between spouses or joint bank accounts. 

                • Accounts and Assets with beneficiaries, transfer on death (“TOD”) directions or payable on death (“POD”) provisions. 

                • In addition, the State of Wisconsin has a small estate settlement option to avoid probate, if your individual assets are less than $50,000 in total. The amount and options vary by state. 

                • Additional options available to avoid probate include Revocable Trusts, and, in some states, Marital Property Agreements. 

        Probate could be a better option in certain circumstances, including: 

                • If you were to die with minor children who need to have a legal guardian appointed to take care of them going forward. 
                • If you die with more debts than you have assets, as the probate court will help settle your final debts with your creditors. 
                • When family members and beneficiaries don’t get along and may contest any aspect of your estate plan, the probate court is the final decision maker on any disputes.  

        If probate is needed, the named personal representative (aka executor) will open an estate proceeding in Probate Court to be legally appointed to act on behalf of the estate. Without the legal appointment by the court, the personal representative has no power.

        Once appointed, the personal representative is given all powers necessary to settle your affairs, which includes the power to identify, collect, and manage assets while ensuring all debts, expenses, claims and taxes are paid prior to making any distributions to named beneficiaries. 

        The probate process is public in nature and can take between 9 and 15 months to complete because of the variety of filing and notice requirements that the personal representative must adhere to along the way. The timeframe isn’t necessarily shorter when using some of the other non-probate transfer options previously mentioned, as there’s always a process to settle one’s affairs after death even without probate. 

        Estate proceedings are often done under the guidance of an estate or probate attorney. While attorneys can be expensive, they can help to simplify the process for personal representatives and ensure that administration proceeds as efficiently as possible.  

        If you’re concerned about Probate, you should get in contact with an estate planning attorney that can advise you on alternatives and help implement a comprehensive estate plan.

        Annex’s own, Brandon Lehman, CFP®, AIF®, Director of Annex Private Client, recently concluded his service of almost eight years to our country as an Engineer Officer in the Wisconsin Army National Guard.

        This past week Brandon retook his Oath of Office upon transferring to the Army Reserves as a Civil Affairs Officer, serving as a Civil Affairs Officer of the 407th Civil Affairs Battalion.
